TERMS OF SERVICE
HARQAH HID SYSTEM AUTHORITY
1.1 Binding Agreement. By registering for a Harqah Identity Document, you agree to be fully bound by these Terms without limitation or exception. If you do not agree, you must not register or use any Harqah ecosystem service.
1.2 Entity Registration. If registering on behalf of an organization, you declare you have full legal authority to bind that entity to these Terms.
1.3 Amendments. The Harqah HID System Authority may update these Terms with 30 days notice. Continued use constitutes acceptance.
2.1 Citizen Registration. You must be a living human being of legal age in your jurisdiction, or have verifiable parental/guardian consent.
2.2 One Identity Per Person. Every person may hold exactly one Citizen HID. Duplicate registration results in permanent banning without appeal.
2.3 Institution Registration. The founding individual must hold an active Citizen HID at Trust Tier Two or above. The institution must be a real, formally organized entity.
2.4 Asset Registration. The registering identity must own the asset. Registering assets that do not belong to you is a material breach.
2.5 Jurisdiction. You must register under your genuine jurisdiction of residence or operation.
3.1 Truthful Information. All information provided must be accurate, complete, truthful, and not misleading.
3.2 Updates. You must update your registered information without unreasonable delay when changes occur.
3.3 No Forged Documents. Submitting forged, altered, or fraudulent documents is a material breach and may be a criminal offence.
3.4 Document Ownership. All government documents submitted must genuinely belong to you.
3.5 Verification Rights. The Authority reserves the right to verify any information at any time, including after issuance.
4.1 Progression. You must progress through trust tiers by genuinely completing required verification steps. Artificial inflation is prohibited.
4.2 Authority. The Authority has sole discretion to set and adjust trust tier thresholds.
4.3 Reduction. A trust tier may be reduced if previously submitted information is found false or fraudulent.
4.4 Tier Two. Your date of birth must match your government document. False dates are a material breach.
4.5 Tier Four. This tier requires formal review; the Authority's decision is final.
5.1 Unlawful Use. Never use your HID for any unlawful purpose.
5.2 Impersonation. Never impersonate any other person, organization, or entity.
5.3 Credential Sharing. Never share your authentication credentials. All activity under your HID is your responsibility.
5.4 Forgery. Never attempt to forge, replicate, or alter any HID string.
5.5 Disruption. Never interfere with or attack the Authority's services or the Harqah ecosystem.
5.6 Harassment. Never use the ecosystem to engage in harassment, abuse, or threats.
5.7 Financial Crime. Never use your HID for illegal financial transactions, money laundering, or terrorist financing.
5.8 PearlMind Conduct. Never violate PearlMind's participation rules or attempt to exploit the simulation environment.
6.1 Authority Rights. The Authority may change any HID's lifecycle status at any time for breach, fraud, risk, or legal requirement.
6.2 Suspension. Temporary denial of access; conditions for removal determined by the Authority.
6.3 Permanent Ban. Irreversible deactivation. The HID record is retained permanently. A banned holder may never register a new HID.
6.4 Review. Extended feature access restricted pending outcome; holder notified where possible.
6.5 Archival. Voluntary archival preserves the record; reactivation through formal application.
7.1 Verification Request. When an institution links you, you will receive a request. You have the right to confirm or reject.
7.2 Confirmation. Confirming means you consent to the linkage being recorded and visible to authorized parties.
7.3 Rejection. Rejecting cancels the request. You are never forced into a linkage.
7.4 Founding Responsibility. If you found an institution, you remain responsible for its accuracy and governance.
8.1 Registered Work Service. Creates an immutable timestamped record of authorship. Does not supersede national copyright law.
8.2 Declaration. By registering a work, you declare you are a genuine author or rights holder.
8.3 Fraud. Registering a work that belongs to another person is identity-linked fraud and a material breach.
8.4 Disputes. The Authority does not adjudicate ownership disputes. Disputed registrations will be placed under review.
9.1 Service Basis. The Authority provides services with reasonable care but does not guarantee uninterrupted availability.
9.2 No Liability for Breach. The Authority is not liable for loss from your failure to comply with these Terms.
9.3 No Liability for Suspension/Ban. No liability arises from actions taken in accordance with these Terms.
9.4 No Advice. Nothing in the ecosystem constitutes legal, financial, or professional advice.
9.5 Liability Cap. To the fullest extent permitted by law, liability is limited to fees paid to the Authority in the preceding twelve months.
10.1 Governing Law. These Terms are governed by the laws applicable to the Harqah HID System Authority as a sovereign identity governance body.
10.2 Internal Dispute Resolution. Disputes shall first be referred to the Authority's formal dispute resolution process.
10.3 Arbitration. Unresolved disputes may be referred to binding arbitration.
10.4 Waiver of Class Action. You waive any right to bring a class action against the Authority.
11.1 Severability. If any provision is unenforceable, it shall be modified or severed, and the remaining provisions continue.
11.2 No Waiver. Failure to enforce any provision does not waive the right to enforce it later.
11.3 No Assignment. You may not transfer or assign your rights or obligations under these Terms.
11.4 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement.
